By accessing or using GARAJI OS ("the Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of these terms, you may not access the Service.
These Terms apply to all users of the Service, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.
Permission is granted to temporarily access the materials on GARAJI OS for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
This license shall automatically terminate if you violate any of these restrictions and may be terminated by GARAJI at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

If you subscribe to a paid plan:
You retain ownership of all content you upload, post, or transmit through the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your User Content solely for the purpose of providing and improving the Service.
You are solely responsible for your User Content and warrant that it does not violate any third-party rights or applicable laws.

The Service and its original content, features, and functionality are owned by GARAJI Systems and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written consent.
The materials on GARAJI OS are provided on an 'as is' basis. GARAJI makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
Further, GARAJI does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.
In no event shall GARAJI or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on GARAJI OS, even if GARAJI or a GARAJI authorized representative has been notified orally or in writing of the possibility of such damage.
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.
These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Kenya.
GARAJI may offer or operate the following surfaces in addition to core garage / fleet workspace software. By using them, you agree to these supplemental terms together with the rest of this agreement.
We may display business information (e.g. name, location, services, contact details) in a public directory or marketplace when you or your organisation opt in (e.g. directory listing settings) or when we create a discoverable profile from your account data as described in our Privacy Policy. You are responsible for the accuracy of what you publish. You may request corrections or delisting subject to our processes and any contractual commitments.
Where we offer a "claim" flow, you may verify control of a listed business (e.g. via one-time codes sent to a phone number you provide). You represent that you are authorised to act for that business. False or fraudulent claims may result in suspension or legal action. After a successful claim, onboarding may link your account to that listing as described in the product.
A listing-type account may have a reduced feature set focused on public presence, leads, and related tools. The same Terms apply; certain modules (e.g. full job cards, inventory ERP) may not be included in your plan.
Where we operate a parts or supplier marketplace: orders, pricing, fulfilment, returns, and disputes may involve third-party sellers as well as GARAJI. You agree to comply with checkout rules, delivery/logistics communications, and any supplier-specific terms presented at purchase. We may facilitate payments and records (e.g. invoices) as part of the Service.
Public booking slots and appointment requests are offered subject to garage availability and configuration. Bookings are between the motorist and the garage; GARAJI provides software to request and manage slots. We do not guarantee availability, quality of work, or outcomes. Features may be enabled or disabled in phases (see 13.9).
Contact forms, WhatsApp or phone links, marketplace messages, and similar features may generate "leads" for garages or suppliers. Fees, attribution, or billing for leads (where applicable) are governed by your plan, in-product notices, and separate commercial terms where we provide them.
Where the Service supports insurance-related workflows (e.g. evidence, estimates, assessor communication), you understand that insurers and garages remain responsible for regulatory compliance and claim decisions. GARAJI is a software platform, not an insurer or licensed assessor unless expressly stated otherwise in writing.
We may send operational, security, and product messages through email, SMS, or messaging channels. You agree that we and configured providers may process the contact details you supply for those purposes. Marketing messages, where used, will be handled in line with applicable law and your preferences where we offer them.
Some features (including discovery, trust surfaces, booking, or dispatch-related tools) may be turned on or off for maintenance, safety, or staged release. APIs may respond with a temporary "service unavailable" style response when a phase is disabled. This does not waive fees already earned or material obligations that have already accrued.
We may operate a waitlist or invite-only signup. Access tokens, cookies, or server-side checks may be used to enforce who may register or use certain URLs. Circumventing those controls is a breach of these Terms.
Features that integrate with KRA eTIMS or similar systems are tools to help you meet your obligations. You remain solely responsible for accurate filings, credentials, and compliance with tax and trade law.
The Service may link to or embed third-party sites (e.g. maps, messaging, analytics, payment, or logistics providers). Your use of those services may be subject to the third party's terms. We are not responsible for third-party content or failures outside our reasonable control.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
